These Terms and Conditions ('Terms') govern all relationships between StayliaDXB ('Company,' 'we,' 'us,' 'our') and any individual or entity ('you,' 'Client,' 'Owner,' 'Investor,' 'User') who:
• Visits or uses the StayliaDXB website (stayliadxb.com)
• Submits contact or lead information through any channel including WhatsApp, email, social media, or website forms
• Engages StayliaDXB for property management services
• Receives investment advisory information or consultation from StayliaDXB
• Enters into any commercial arrangement with StayliaDXB
By accessing our website, submitting your information, or engaging our services, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must cease using our platforms and services immediately.
These Terms should be read alongside our Privacy Policy, which is incorporated herein by reference.

StayliaDXB is not a licensed real estate brokerage and does not act as a real estate agent. We do not earn commission from property sales or off-plan developer transactions. Our business is exclusively property management and investor-led advisory.
3. Website Use
3.1 Permitted Use
You may access our website for lawful purposes and personal, non-commercial information gathering. You agree not to:
• Use our website to transmit unsolicited commercial communications
• Attempt to gain unauthorised access to any part of our systems
• Upload or transmit viruses, malware, or any other harmful code
• Scrape, copy, or republish our content without express written permission
• Use our website in any way that violates applicable UAE law or international law
3.2 Intellectual Property
All content on the StayliaDXB website and social media channels — including text, graphics, logos, videos, scripts, data, photography, and branding — is the exclusive intellectual property of StayliaDXB or its licensors. Reproduction, distribution, or commercial use of any content without our prior written consent is strictly prohibited.
3.3 Disclaimer of Warranties
Our website is provided on an 'as is' and 'as available' basis. We make no representations or warranties of any kind, express or implied, regarding the accuracy, completeness, reliability, or suitability of the information contained on our website. We reserve the right to modify or withdraw website content without notice.
3.4 Limitation of Liability — Website
To the fullest extent permitted by applicable UAE law, StayliaDXB shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of, or inability to use, our website. This includes but is not limited to loss of data, revenue, profits, or investment returns.
4. Lead Generation and Contact Information
4.1 Submission of Contact Information
When you submit your name, email address, phone number, WhatsApp number, or any other personal information through our website, social media, or any other channel, you:
• Confirm that the information provided is accurate and belongs to you
• Consent to being contacted by StayliaDXB via WhatsApp, email, or telephone in relation to our services
• Understand that your information will be processed in accordance with our Privacy Policy
• Acknowledge that submitting your information does not create a binding contract or obligation on either party
4.2 No Guarantee of Response
Submission of contact information does not guarantee that we will respond, offer services, or enter into any commercial arrangement with you. We reserve the right to decline or discontinue contact with any individual at our sole discretion.
4.3 Marketing Communications
By submitting your contact information, you consent to receiving marketing communications from StayliaDXB including but not limited to investment insights, service updates, market analysis, and event invitations. You may opt out at any time by replying 'STOP' to any WhatsApp message, emailing contact@stayliadxb.com, or using the unsubscribe mechanism in any email communication. Opt-out requests will be processed within five (5) business days.
4.4 No Financial Advice
Information provided by StayliaDXB through any channel — including our website, social media, YouTube videos, WhatsApp messages, and consultations — is for general informational and educational purposes only. Nothing we communicate constitutes regulated financial advice, investment advice, legal advice, or tax advice. You should obtain independent professional advice before making any investment decision. StayliaDXB accepts no liability for any investment decisions made based on information we provide.
5. Property Management Services
5.1 Scope of Services
Where StayliaDXB is engaged to manage a property, the scope of services will be set out in a separate Property Management Agreement ('PMA') executed between the Company and the property owner. In the absence of a signed PMA, no management services will be provided and no management relationship exists.
Standard services included in a property management engagement may include:
• Listing and optimisation on short-term rental platforms (Airbnb, Booking.com, VRBO, direct channels)
• Dynamic pricing management
• Guest communication and vetting
• Key management, check-in, and check-out coordination
• Cleaning and linen management coordination
• Routine maintenance coordination and minor repair facilitation
• Financial reporting and income disbursement
• DTCM compliance and license administration (where agreed)
5.2 Client Obligations
As a property owner engaging our services, you agree to:
• Provide accurate and complete information about your property, ownership status, and any encumbrances
• Ensure the property is legally available for short-term rental use under applicable DTCM regulations and building rules
• Maintain adequate building insurance and contents insurance for your property
• Notify us promptly of any material changes to the property's legal status, physical condition, or ownership
• Pay all service charges, owner corporation fees, DEWA bills, and any other property-related costs on time unless otherwise agreed in writing
• Obtain and maintain all permits, licenses, and approvals required for holiday home operation
• Not engage any other property management company for the same property during the term of an active PMA with StayliaDXB
5.3 Management Fees
Management fees are as specified in the PMA. Unless otherwise agreed in writing:
• Fees are calculated as a percentage of gross rental revenue collected
• Fees are deducted prior to disbursement of owner proceeds
• One-time setup, photography, and onboarding costs may apply and will be disclosed in advance
• Platform transaction fees charged by Airbnb, Booking.com, or other channels are separate from StayliaDXB management fees
5.4 No Guarantee of Income
StayliaDXB does not guarantee any specific level of rental income, occupancy rate, or return on investment. Rental income depends on market conditions, seasonality, property condition, pricing strategy, and factors outside our control. Historical performance data or projections we share are illustrative only and do not constitute a guarantee or warranty of future performance.
5.5 Owner Access
During an active management engagement, the property owner must provide advance notice before accessing the property to avoid disruption to active bookings. Emergency access is exempt from this requirement. We reserve the right to charge a reletting fee if owner access results in a confirmed booking cancellation.
5.6 Property Damage
StayliaDXB will take reasonable precautions to vet guests and protect your property. However, we are not liable for damage caused by guests, third parties, natural events, or circumstances outside our control. Property owners are required to maintain their own property insurance. Where platform host guarantees apply (such as Airbnb's AirCover), we will assist in facilitating claims but make no warranty as to their outcome.
6. Investment Advisory and Consultations
6.1 Nature of Advisory Services
StayliaDXB offers informal investor-to-investor consultations and market insights based on the founder's personal experience and portfolio data. These consultations are not regulated financial advisory services. Nothing communicated in a consultation, email, WhatsApp message, video, social media post, or written document constitutes a regulated investment recommendation.
6.2 No Agency Relationship
StayliaDXB does not act as a buyer's agent, seller's agent, or real estate broker. We do not facilitate property transactions and do not earn commission from property sales. Any introduction to sellers, agents, or properties is made informally and at your own risk.
6.3 Due Diligence Responsibility
You are solely responsible for conducting your own due diligence before making any property investment. This includes, without limitation, verifying property ownership, reviewing title deeds, confirming regulatory status, obtaining independent legal and financial advice, and assessing market conditions independently.
7. Fees, Payment, and Disbursements
All fees payable to StayliaDXB are as specified in the applicable PMA or service agreement. Unless otherwise agreed:
• Fees are denominated in UAE Dirhams (AED)
• Payment terms are as set out in the PMA, typically within five (5) business days of invoice
• Late payment may attract an interest charge of one percent (1%) per month on the outstanding balance
• StayliaDXB reserves the right to suspend services in the event of non-payment
• Disbursements of owner rental proceeds are made monthly, within the timeframe specified in the PMA, following reconciliation
8. Confidentiality
Both parties agree to keep confidential all proprietary, business, financial, and strategic information shared during the course of their relationship. This obligation survives termination of any commercial arrangement. Confidential information does not include information that: (a) is or becomes publicly available through no fault of the receiving party; (b) was already known to the receiving party; (c) is required to be disclosed by law.
StayliaDXB's systems, pricing methodologies, operational processes, software, and client data are proprietary and confidential. You agree not to replicate, reverse-engineer, or share this information with third parties.
9. Termination
9.1 Property Management Agreement Termination
Termination rights and notice periods are governed by the terms of the applicable PMA. In the absence of specific PMA terms, either party may terminate the management arrangement with sixty (60) days written notice. Termination is subject to the honouring of all confirmed guest bookings that fall within the notice period. Premature termination by the owner prior to expiry of confirmed bookings may result in liability for any losses incurred by StayliaDXB.
9.2 Website and Contact Termination
We reserve the right to block access to our website, terminate communication, and remove contact information from our database for any individual who:
• Provides false or misleading information
• Engages in harassing, threatening, or abusive conduct
• Attempts to circumvent our systems or misuse our platforms
• Violates any of these Terms
10. Indemnification
You agree to indemnify, defend, and hold harmless StayliaDXB, its founder, employees, contractors, and agents from and against any claims, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from:
• Your breach of these Terms
• Your breach of any PMA or service agreement
• Any misrepresentation you make to StayliaDXB or to guests or tenants
• Any violation of applicable UAE law or DTCM regulations in connection with your property
• Any unauthorised use of our website or intellectual property
11. Limitation of Liability
To the fullest extent permitted by applicable UAE law, the total aggregate liability of StayliaDXB to any client or user — whether arising in contract, tort (including negligence), breach of statutory duty, or otherwise — shall not exceed the total management fees actually paid by that client to StayliaDXB in the three (3) months immediately preceding the event giving rise to the claim.
StayliaDXB shall not be liable for:
• Loss of anticipated rental income or investment returns
• Loss of property value or depreciation
• Damage caused by guests, tenants, or third parties
• Consequences of changes to DTCM regulations, DLD requirements, or UAE law
• Force majeure events including natural disasters, government action, pandemic, or civil unrest
• Actions or omissions of third-party platforms including Airbnb and Booking.com
• Any indirect, incidental, special, consequential, or punitive damages of any nature
12. Force Majeure
StayliaDXB shall not be in breach of any obligation under these Terms or any PMA to the extent that performance of such obligation is prevented or delayed by circumstances beyond our reasonable control, including but not limited to: acts of God, government action or regulation, pandemic, war, civil unrest, terrorism, labour disputes, power outages, or failure of third-party platforms or services. We will notify you promptly of any force majeure event and take reasonable steps to resume performance as soon as practicable.
13. Dispute Resolution
In the event of a dispute arising from or in connection with these Terms or any commercial relationship with StayliaDXB, the parties agree to:
• First attempt to resolve the dispute informally through direct negotiation within thirty (30) calendar days of written notice of the dispute
• If informal resolution fails, refer the dispute to mediation administered by the Dubai International Arbitration Centre (DIAC) or a mutually agreed mediator
• If mediation fails, submit the dispute to binding arbitration under the DIAC Arbitration Rules, conducted in Dubai in the English language, with a single arbitrator
Nothing in this clause prevents either party from seeking urgent injunctive relief from a competent court in Dubai.
14. Governing Law and Jurisdiction
These Terms, and all matters arising from or connected with them, are governed by and construed in accordance with the laws of the Emirate of Dubai and the federal laws of the United Arab Emirates. Subject to the dispute resolution provisions above, each party irrevocably submits to the non-exclusive jurisdiction of the courts of Dubai.
15. Entire Agreement
These Terms, together with the Privacy Policy and any applicable PMA or service agreement, constitute the entire agreement between the parties with respect to the subject matter hereof, and supersede all prior negotiations, representations, warranties, understandings, and agreements. No oral representation or prior course of dealing shall be binding.
16. Severability
If any provision of these Terms is found by a competent court or arbitrator to be invalid, unlawful, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed from the Terms without affecting the validity or enforceability of the remaining provisions.
17. Waiver
No failure or delay by StayliaDXB in exercising any right, power, or privilege under these Terms shall operate as a waiver of that right. No single or partial exercise of any right shall prevent the further exercise of that right. All waivers must be in writing and signed by an authorised representative of StayliaDXB.
18. Amendments
We reserve the right to amend these Terms at any time. Amendments will be posted on our website with an updated effective date. Continued use of our website or services following any amendment constitutes acceptance of the revised Terms. For active property management clients, material changes to the Terms governing the management relationship will be communicated directly and require mutual written agreement.
19. Assignment
You may not assign or transfer any rights or obligations under these Terms or any PMA without the prior written consent of StayliaDXB. We reserve the right to assign our rights and obligations under these Terms to a successor entity in the event of a business restructuring, merger, or acquisition, subject to written notification to affected clients.
20. Notices
All formal notices required under these Terms must be in writing and delivered by email to contact@stayliadxb.com (for notices to StayliaDXB) or to the email address on file for the relevant client. Notices are deemed received on the next business day following transmission, provided no delivery failure notification is received.
ACKNOWLEDGEMENT
By using the StayliaDXB website, submitting contact information, or engaging our services, you confirm that you have read and understood both this Privacy Policy and these Terms and Conditions in their entirety, and that you agree to be bound by them.
